Welcome to Diamond Brothers. These Terms and Conditions govern your use of our website https://diamondbrothers.com and the services we provide, including diamond and jewellery valuation, purchase, shipping, and in-person consultations. By using our site or services, you agree to these terms in full.

1. General Scope

• We offer free valuations of diamonds and jewellery, followed by optional purchase offers.
• You are under no obligation to accept an offer.
• Ownership remains with you until the transaction is completed and payment is made in full.

2. Valuation Services

• All valuations are free of charge and non-binding.
• Online or preliminary valuations are indicative and may change after physical inspection.
• Final offers are based on the item’s condition, weight, purity, certification, and current market prices.
• Valuations are valid only for the date issued due to fluctuations in the diamond market.

3. Proof of Ownership

• You confirm you are the lawful owner of any items submitted and have the full legal right to sell them.
• Transactions require valid identification in accordance with KYC and EU Anti-Money Laundering regulations.
• If we suspect an item is stolen, counterfeit, unlawfully obtained, or misrepresented, we reserve the right to refuse or cancel the transaction and may notify the relevant authorities.

4. Authenticity & Condition Verification

• All items are subject to inspection by our gemologists.
• If an item is found to be synthetic, treated, or materially different from its description, we may adjust or withdraw the offer.
• We may request supporting documentation (e.g., certificates, receipts) before finalizing a purchase.

5. Payment Terms

• Payment is initiated immediately after acceptance of our final offer.
• Funds are transferred via bank transfer or another mutually agreed method.
• We are not responsible for delays caused by banking systems, payment processors, or external verification checks.

6. Shipping & Risk Transfer

• We offer free, insured FedEx pickup, including packaging instructions.
• Items are insured from the moment they are collected by our courier until arrival at our premises.
• The maximum insurance limit per shipment will be communicated to you in advance. If your item exceeds this limit, you must declare this, and additional insurance can be arranged at your cost.
• Risk transfers to Diamond Brothers upon signed collection by our courier.
• We are not responsible for loss or damage before items are collected by our designated carrier.

7. In-Person Appointments

• You may book an in-person appointment for evaluation.
• If you decline our final offer, you can take your items back immediately, in the same condition as received, excluding normal handling during evaluation.

8. Return Policy

• If you decline our final offer after shipping an item to us, we will return it securely, fully insured, at no cost to you.
• Returns will use the same level of insurance and shipping method as received.

9. Consumer Rights & Cooling-Off Period

• If applicable under EU Consumer Rights Directive, you have a 14-day cooling-off period for distance transactions.
• However, where a transaction is completed and payment is made immediately upon acceptance of the offer, you acknowledge and agree that this right is waived as per Article 16 of the Directive.

10. Customs, Taxes & Cross-Border Transactions

• Customers are responsible for accurate customs declarations when sending items from outside Belgium.
• Any applicable duties or taxes must be declared truthfully in accordance with customs laws.

11. Privacy & Data Protection (GDPR)

• We collect personal data (name, contact details, ID documents, transaction details) to provide our services, comply with legal obligations, and prevent fraud.
• Lawful bases for processing: contract performance, legal obligation, and legitimate interest.
• We store data securely for up to 5 years after transaction completion to meet legal and regulatory requirements.
• You have the right to access, correct, or request deletion of your data, and to lodge a complaint with your local Data Protection Authority.
• We do not sell your data. We may share it only with trusted service providers (e.g., couriers, payment processors) or when required by law.

12. No Pressure to Sell

• You may decline any valuation without penalty.
• Declining an offer will not affect your eligibility for future valuations.

13. Limitation of Liability

• We are not liable for indirect, incidental, or consequential losses.
• Our maximum liability is limited to the final agreed purchase price of your item.
• We are not responsible for market price fluctuations after valuation.

14. Force Majeure

• We are not liable for delays or failures caused by events beyond our reasonable control, including strikes, courier disruptions, natural disasters, or regulatory changes.

15. Intellectual Property

• All content on our site (text, logos, images, tools) is owned by Diamond Brothers and protected by intellectual property laws.
• You may not reproduce or distribute our content without written consent.

16. Website Use

• You agree to provide accurate information and not to submit fraudulent or misleading descriptions of items.
• We are not responsible for website downtime, errors, or technical interruptions.

17. Governing Law & Jurisdiction

• These terms are governed by Belgian law.
• Any disputes will be subject to the exclusive jurisdiction of the courts of Antwerp, Belgium.

18. Modifications to Terms

• We may update these terms at any time. Updated terms will be posted on this page with the new effective date.
• Continued use of our services constitutes acceptance of the updated terms.
